§ 105-49. Permitted uses; restricted uses.

  • A. 
    In any Business B District, no building or premises shall be used, and no building or part of a building shall be erected, intended or designed to be used, in whole or in part, for any use other than stores for retail merchandising, personal service shops, offices and buildings permitted in the Residence C District. No such use shall be deemed to include a business involving the consumption of alcoholic beverages on the premises, unless such is merely incidental to the main or principal use of said business.
    B. 
    No building or premises shall be used for the sale of prepared food for consumption on the premises except by waiter or waitress service to persons seated at tables or counters located within the building, to be eaten at such tables or counters. No building or premises shall be used for the sale of food for consumption off the premises, except for a retail grocery, a delicatessen, other store primarily selling food items packaged in units of more than one portion or a restaurant selling take-out orders, provided that such orders are only an incidental part of the business of such restaurant consisting of less than 10% of its gross sales.
